Terms of service.

1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and Lafrancian Enterprises ("Lafrancian," "we," "us," or "our"). By accessing lafrancian.com or using a Lafrancian-operated service that links to these Terms, you agree to them. If you use a service for an organization, you represent that you are authorized to act for that organization.

If you do not agree, do not use the applicable website or service.

2. Our services

Lafrancian builds and operates software, including Crewenda, a construction operations platform. Service features, availability, and eligibility may change over time. Additional product, subscription, or organization terms may apply. If service-specific terms conflict with these Terms, the service-specific terms control for that service.

Operational information shown in a Lafrancian service is a coordination aid. Your organization remains responsible for its people, worksite practices, safety decisions, payroll decisions, legal obligations, and the accuracy of information it provides.

3. Accounts and authorized use

You must provide accurate information, keep account credentials confidential, and promptly report suspected unauthorized access. You are responsible for activity performed through your account to the extent permitted by law.

Organizations are responsible for assigning appropriate access, keeping user and mobile information current, and ensuring that administrators who record SMS consent have received a genuine, separate authorization from the mobile-number owner.

4. Crewenda SMS program terms

Program name: Crewenda

Crewenda sends optional operational and service messages to authenticated users who have given current, phone-specific consent. Messages may concern work assignments, dispatches, schedule updates or changes, missing time entries, reminders, operational alerts, and account or service information.

• Message frequency: Recurring; frequency varies with work activity and account events.
• Charges: Message and data rates may apply.
• Opt-out: Reply STOP to opt out. Applicable standard opt-out variants may also be honored by the messaging provider.
• Help: Reply HELP for help, visit lafrancian.com/contact, or email kajlafrancian@gmail.com.
• Optional consent: Consent to receive SMS is not a condition of creating an account, using Crewenda, or receiving the underlying in-app information.

Carriers are not liable for delayed or undelivered messages. SMS delivery is not guaranteed, and the applicable in-product record remains authoritative if a message is delayed, filtered, or not delivered.

START or UNSTOP may remove provider-level suppression where supported, but does not by itself recreate Crewenda consent. Crewenda messaging resumes only after the mobile-number owner explicitly requests re-enrollment and fresh consent is recorded for the current number.

5. Acceptable use

You may not:

• use a service unlawfully or to infringe another person’s rights;
• attempt to bypass access controls, security measures, or usage limits;
• introduce malicious code or interfere with service operation;
• scrape, probe, reverse engineer, or access a service except as permitted by law or written authorization;
• submit content you do not have the right to use; or
• use Crewenda messaging for unsolicited marketing, purchased lists, free-form broadcasts, or messages outside the authorized operational program.

We may suspend or restrict access when reasonably necessary to protect users, the service, or legal compliance.

6. Ownership and feedback

Lafrancian and its licensors retain all rights in the websites, services, software, branding, and related materials, except for content owned by users or their organizations. Subject to applicable service terms, you retain your rights in content you provide.

If you send suggestions or feedback, you grant Lafrancian permission to use them without restriction or compensation, while we remain responsible for protecting any personal information under our Privacy Policy.

7. Disclaimers and limits

To the extent permitted by law, the website and services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted or error-free operation.

To the extent permitted by law, Lafrancian will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from these Terms or the service. Any additional limits or remedies in a signed service agreement remain in effect.

Changes and termination

We may change or discontinue features and may update these Terms. Material changes will be posted with a new effective date. You may stop using the website or service at any time, subject to any separate agreement.

Governing law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Entire agreement and severability

These Terms and any applicable service-specific agreement form the agreement for the covered service. If a provision is unenforceable, the remaining provisions remain in effect. A waiver must be explicit and does not waive later enforcement.
